Experian Compliance for B2C Consumer Vehicle History Checks
When offering vehicle history checks directly to consumers, Experian compliance is a critical part of the integration process. Compliance standards are in place to ensure data is presented correctly, and ensure there is no liability for any of the parties involved – including your business. We help our customers meet these compliance requirements efficiently.
Below are the key points you’ll need to observe as part of your integration of Experian data in order to achieve approval to resell the data to consumers.
1. Disclosure of Business Entity Details
We are required to disclose your identity to Experian.
Your business identity should also be clearly disclosed to consumers on your website.
Including:
Your registered business name or if a sole trader your name
Company number (if applicable)
Contact information and trading address
This transparency ensures consumers know exactly who is providing their vehicle history report and how to contact you for support.
2. ICO Registration
To handle personal and vehicle data responsibility, your entity must be registered with the Information Commissioner’s Office (ICO) and this is a minimum requirement from Experian for reseller approval.
Your need to provide us with a valid ICO registration number prior to Experian compliance approval.
3. Review of Landing Pages and Sample Report
Experian will conduct a review of your website landing pages and a sample vehicle check to verify that:
The consumer experience is clear, fair, and not misleading
Data is presented accurately, in context
Data attributions are in place
4. Data Attribution- "Data Provided by Experian"
Reports that include Experian data must contain a visible reference to:
“Data provide by Experian” is against the required sections or individual items, or this can be for the entire report if all data is being provided by Experian.
If providing data from multiple sources in your report then you should ensure Experian is not referenced as the supplier of any non-Experian data, and in this scenario referencing by section is our recommended approach.
5. Review of Terms & Conditions
Your Terms and Conditions will be reviewed to confirm that clauses excluding liability for data errors are in place, with appropriate disclaimers limitations.
If you are including a data guarantee your terms and conditions must contain a link to the Experian data guarantee terms and conditions, ensuring these are explicitly agreed to as part of the terms of sale.
Pre-Compliance Check by One Auto
Once your integration with One Auto API is complete, we provide a free pre-compliance review before submission to Experian.
This proactive check helps identify and correct any non-conformities early – ensuring a smoother, faster approval process with Experian.
In Summary
Experian compliance is an essential part of offering trusted, transparent, and legally sound vehicle history checks. By meeting these requirements, your business not only gains approval faster but also builds stronger consumer trust and credibility by being able to reference Experian as the data provider.
